How will a court pick between competing monitors? Is the US court willing to recognize a Canadian RVO with out-of-plan releases?

  • the Nova Scotia Supreme Court’s decision in the Saltwire case, which dealt with competing CCAA applications by the debtor and the creditor, who each proposed their own monitor;
  • the Ontario Superior Court’s decision in the Trees case, which considered whether a firm’s mandate as a company’s former auditor disqualified it (or a related entity) from acting as the company’s CCAA monitor;
  • the concerns expressed by the Delaware Court in recognizing an RVO in the Goli case; and
  • the Delaware Court’s consideration of whether it should recognize releases granted as part of a vesting order approved in the Xebec matter.
