Q2 2021: New Case Law Shaking Up Established Insolvency Practices

July 2021

Agenda

Over the last few months, courts across Canada have released decisions that have the potential to change the practice of insolvency law as we currently know it. From the Supreme Court’s recent expansion of the Sierra Club test, to the judicial admonition against seeking interim approvals of a receiver’s activities, Q2 2021 was full of noteworthy – and sometimes surprising – case law that may be the catalyst for some major changes going forward.

Join us for an informative half-hour discussion in which our expert panel shares five significant issues that have dominated the insolvency landscape in the last quarter. We’ll cover, among other things, the following:

  • case law interpreting the new statutory duty of good faith;
  • creative new ways that reverse vesting orders are being used;
  • a number of efficient bespoke claims processes that have been approved under both the CCAA and the BIA;
  • the Supreme Court’s modification of the test for granting a sealing order in the Sherman Estate decision; and
  • a decision of the Ontario Superior Court of Justice that has called into question the practice of seeking interim approvals of a receiver’s activities.
