Q4 2021: Capping Off Another Bizarre Year in Insolvency

Much like the rest of the year, Q4 2021 was relatively slow in terms of filings, but was replete with important and, in some cases, precedent-setting decisions. This quarter’s case law spanned a wide variety of issues, covering topics including priming charges, priority disputes, set off and environmental obligations. We also saw a number of controversial and buzz-worthy cases go to court.

Join us for an informative 45 minute discussion in which our expert panel discusses a number of significant cases that have the potential to impact insolvency practice going forward. We’ll cover, among other things, the following:

  • a pending issue before the Québec Court of Appeal pertaining to the interpretation of the Supreme Court’s split decision in Canada North and, more specifically, whether the Court can order priming charges above the Crown’s deemed trust under s. 183 of the BIA;
  • Chief Justice Morawetz’s refusal to approve a related party sale in the CCAA proceedings of the McEwan Restaurant Group;
  • cases in the wake of the Supreme Court’s decision in Redwater that have grappled with priority issues where environmental obligations exist, and where the law seems to be headed;
  • the Supreme Court’s recent treatment of pre-post compensation under the CCAA;
  • how law and politics have intersected in the CCAA proceedings of Laurentian University; and
  • a case dealing with the issue of whether bankruptcy proceedings can be converted into CCAA proceedings.
